We are not war traders, and our blood is not cheap, and all we want is pride and humanity just like all the other peoples of the world ...

Just a reminder…
We would like to inform you of a fraction of what the Gaza Strip suffers due to the Israeli blockade - before this current aggression: social and economic problems (in all aspects of life), our right to freedom of self-determination and sovereignty, the crisis of prisoners, the inability to access the West Bank, Jerusalem, Al-Aqsa mosque and other holy sites.

1. Electricity is available for only 8 hours per day, and not even regularly as it depends on the availability of diesel fuel which is controlled by the Israelis.
2. 90% of the water found in the Gaza Strip is unbootable and unfit for human use such as bathing, washing etc…
3. Sanitation and water treatment are nonexistent so waste water is routed directly to the sea, so the beach has been closed because it's become unfit for swimming. This is the only choice for the population as supplies and equipment are controlled by the Israelis.
4. The problem of fuel and gas ... it’s not available in most cases and when it's available the price is exorbitant so it's become the most expensive gas in the world at $2.20 per liter for petrol. It is also causing a problem with cooking as there isn't propane, and if it is available again it is very expensive.
5. Cement and building materials only come for the international institutions with a limited supply and more than half of the goods and materials are not allowed to enter because of false security reasons. They destroy our homes and businesses, and then require us to purchase the materials to rebuild the same at exorbitant prices.
6. Unemployment is above 50% with such a large number of unemployed, aid from international organizations isn't enough to meet even basic needs.
7. 90% of the factories lie idle as there aren't materials or supplies to keep them running because of "security" reasons.
8. Agricultural lands of which most are located in the border areas are considered the primary source of food to cover the needs of the population. The occupation doesn't allow them to grow there because of alleged aggression by farmers. We can't import food; we can't grow our own food, so we are to starve ourselves?
9. Fishing is only permitted within 2 miles, and even then the fishermen face aggression and attacks.
10. Waste disposal is almost impossible as there isn't enough space to handle all the solid waste produced by the population. Attempts to remove it to outlying areas are often met with Israeli aggression.
11. The lack of freedom of travel and movement to and from the Gaza Strip makes the residents of the Gaza Strip prisoners in their own country. Crossings are semi-permanently closed, and the only crossing to the outside world in Rafah crossing is closed almost continuously. The only airport in Gaza has been closed for more than 12 years.
12. The lack of medical supplies and modern treatments is another source of death and suffering for the Gaza Strip. Treatable diseases like diabetes and kidney disease are killing people due to lack of supplies and equipment.
13. Government employees who are working throughout the day and night such as teachers, doctors, nurses etc., haven't received their salaries to cover even their basic needs due to the economic blockade.

Dear World,

How can you accept this suffering and allow your fellow human beings to live like this? The people in your prisons live a much better life full of dignity and safety than the people of Gaza.

Please intervene to stop the siege and suffering from Israel upon us. Don't we deserve to live humanely and in honor like all other human beings?

Dear President Sandro Rossell
We, Palestinian footballers, athletes and sporting organizations and
officials, are dismayed to learn the great team of Barcelona will host
Gilad Shalit to the Classico, Barcelona vs. Real Madrid, on October 7th
,while
more than 5000 Palestinian political prisoners remain rotting, many in
isolation, many with no visits, many on hunger strike with no attention or
care for them to be released.
The arbitrary arrest of thousands of Palestinians, including Gazan
Palestinian National Team football star Mahmoud Kamel As-Sarsak, who was
held without trial or indeed public explanation for the arrest, is a
routine tool of Israeli occupation. Mahmoud was only released after a 95
day hunger strike. Many others are in Israeli prison on hunger strike as we
write, some close to death. Mahmoud Sarsek lost 3 years of his football
career and nearly died while protesting with the only means possible to
him. He deserves to be hosted!
Joseph S. Blatter, President of FIFA (Fédération Internationale de Football
Association), has expressed “grave concern” towards Israeli practices and
its restrictions on Palestinian players, especially those incarcerated in
Israeli prisons, or banned from assembling for the national team. And
Michele Platini said, “Israel must choose between allowing Palestinian
sport to continue and prosper or be forced to face the consequences for
their behaviour.”
The Israeli illegal military occupation of Palestine and the five- year
siege on Gaza has suffocated the aspirations of Palestinian sports men,
women and youth for decades. So where are the consequences? Political
support for Israel’s practices by hosting one of the Israel Occupation
Force soldiers from one of the world’s greatest clubs?!
More Palestinians in Gaza support Barcelona than any other club, especially
among children who make up the majority of the population. We, in Gaza,
have all been through so much under a hermetic siege, regular bombardments,
and frequent incursions. The use of overwhelming force in Operation Cast
Lead in winter 2008-09 was responsible for levelling large swathes of Gaza
including the Rafah National football Stadium, and killing football players
Ayman Alkurd, Shadi Sbakhe and Wajeh Moshate, as well as over 1,400 other
Gazans. National team goalkeeper, Omar Abu Rwayyis, was arrested by Israeli
police in 2012 on “terrorism charges,” a label used for people whose life
was football, not politics. Many times the Palestinian team could not
assemble, train or participate in tournaments because of Israeli illegal
restrictions on player movement.
Our footballers are continually deprived entry or exit from what many
main-stream Human Rights Organizations call the world’s largest open-air
prison. .You must be aware of the example last year when Israel refused to
allow six members of the Palestinian national team to travel from Gaza to a
match against Mauritania. Like everyone stranded in Gaza, Israeli spokesmen
said the players were denied access for “security reasons”, claiming they
did not have the correct permit, reminiscent of the notorious racist “pass
law” in Apartheid South Africa. This is a continuous systematic policy for
all of us that has decimated our involvement in international sport. The
uncertainties from refused permissions to leave and enter the Strip and the
changing severity of the Israeli Siege and Occupation are a major
impediment and as a result the West Asian Union Federation does not always
schedule games involving our teams.
In 2007 the national team was prevented from travelling to play a World Cup
Qualifier in Singapore and eliminated, and in May 2008 for the AFC
Challenge Cup denying them qualification for the 2011 Asia Cup. The Olympic
players from Gaza have been barred from entry to the West Bank and the
youth teams have frequently been denied exit and re-entry.
During Israel’s criminal attacks on Gaza in 2009 our national stadium was
targeted and destroyed, as was the Palestinian Football Association
building. A new stadium planned to be built in Gaza, Beit Lahiya, was
ceased because of the continuing Israeli siege, which still bars concrete
from entering the Gaza Strip along with other sports equipment. And the *
only* grass pitch in Gaza had previously been blown up by an Israeli
missile forcing the national team to play matches in a virtually empty
stadium in Qatar.
Just as the effective boycott of sports teams from the South African
apartheid regime showed, sporting and political life cannot be separated.
We ask you to not show solidarity with the army that oppresses, imprisons
and kills Palestinian sportsmen and women in Palestine, and instead reach
out to those Palestinian footballers with destroyed dreams and broken
opportunities due entirely to the Israeli regime’s apartheid policies
against them.
In the words of Mahmoud Sarsek:
As a released prisoner, Palestinian national team footballer
and big fan of FC Barcelona, I strongly condemn the club’s decision to
invite the Israeli soldier Gilad Shalit to one of their matches and I call
on them to cancel this decision. There are almost 5000 political prisoners
held captive in Israeli jails, suffering daily the horrifying Israeli
prison practices that violate international humanitarian law and
international agreements. Our prisoners, many of whom are footballers and
other athletes, are facing some of the most brutal methods and practices of
psychological and physical torture. Only former captives like myself know
the full story of such oppression and humiliation which will haunt us for
many years to come. I call on FC Barca to boycott participation with
Israeli sports teams and call for boycott, divestment and sanctions of
Israel until it allows Palestinians their fundamental rights, including the
right to participate freely in sport and sports competitions. Do not invite
the Israel Occupation Forces soldier Gilad Shalit when so many Palestinians
rot in Israeli prisons for the crime of being Palestinians who wish to play
football and other sports.
Hosting Gilad Shalit is like parading a SADF soldier during the 1980s at a
European soccer match. Would you have done that, F.C Barcelona?

Diabetic Palestinian political prisoner Akram Rikhawi has been on a hunger strike for 85 days and is at imminent risk of dying.

According to the World Medical Association, in most cases death occurs between 42nd and 72nd days of hunger strike. Rikhawi suffers from various chronic conditions: diabetes, asthma, osteoporosis, kidney problems, and deterioration of his eye lenses, high cholesterol, and immune deficiency. Due to these pre-existing conditions Rikhawi's hunger strike has weakened his body, and already a month ago he was in very fragile condition. Now he is in a coma and his condition is deteriorating fast.

Akram Rikhawi went on hunger strike on 12 April as a protest when he was not granted an early release on the basis of his medical condition and social circumstances. (He has got 8 biological and 5 adoptive children.) He has requested for early release twice: in 2010, and on 5 June 2012. Every prisoner is entitled to ask to be considered for early release when at least two thirds of their sentence has been served. In all discussions, these factors were disregarded and a file with 'secret information' was the only material considered.

Rikhawi from Gaza was arrested by Israeli occupation forces in 2004 and sentenced to 9 years’ imprisonment by a military court. Israeli military courts have almost 100% conviction rate: 99.74% of those who are charged are convicted (Israeli Military Court report 2010).

During his hunger strike Rikhawi has only seen an independent doctor once, on 6 June. Physicians for Human Rights-Israel (PHR-I) has made numerous requests to gain access to Rikhawi, but the Israeli authorities continually denied their requests.

Following the visit on 6 June, the PHR-I doctor reported that Rikhawi's weight had decreased from 68 kilos to 50 kilos, which is a total loss of 26.5%. The doctor further determined that a combination of inflammation of prior chronic illnesses and the complications of hunger strike rendered hospitalization immediately necessary, as he was at immediate risk of death. The Israeli Prison Service (IPS) medical centre is not a hospital, and it is not properly equipped to handle the physical deterioration and effects of long-term hunger strike.

Rikhawi has been held in the IPS medical unit in Ramleh ever since his initial arrest. On 14 June 2012 the Israeli District Court rejected a PHR-I appeal to transfer him to a civilian hospital despite his critical condition. The decision was based on a medical opinion of the IPS, which denies that his life is in danger. According to the PHR-I, 'this opinion is in complete contradiction to the one of the independent doctor, and is not referring to any medical data on which it is based. It also does not relate to the opinion of the independent doctor and the risks it cites.' Last week Rikhawi was briefly hospitalized to a civilian hospital several times, but returned to Ramleh prison clinic. This moving back and forth a patient in such a critical condition could also amount to a medical neglect. Rikhawi has also been shackled to his hospital bed with three limbs.

On Tuesday 19 June, Addameer lawyer, Ms. Neddaf, noted following her visit to Ramleh prison medical clinic that Rikhawi was extremely tired, weak and weighed only 49 kilos. Furthermore, since 16 June, he has been refusing any vitamins and fluids through an IV. (The IPS doctors' threats to force-feed and force-treat him, in addition to their determination not to recommend his medical condition as worthy of earlier release from prison, has led Rikhawi to regard them with deep distrust.) Though he is sustaining himself on water alone, Ms. Neddaf was troubled to observe that even drinking water was very difficult for him and he was only able to consume approximately one litre per day.

There are currently other hunger strikers in Israeli prisons that also need your attention, but Akram Rikhawi's situation is the most critical right now.

El CPDH hace un llamamiento a la comunidad internacional para salvar las vidas de los presos palestinos, Mahmoud al-Sarsak y Akram al-Rakhawi, que están en huelga de hambre

 

El Centro Palestino para los Derechos Humanos (CPDH) expresa su extrema preocupación por la suerte de Mahmoud al-Sarsak y Akram al-Rakhawi, que están en huelga de hambre en las cárceles israelíes desde hace 88 y 68 días respectivamente. El CPDH sostiene que las Fuerzas de Ocupación Israelíes (FOI) son responsables de sus vidas, y exhorta a la comunidad internacional a ejercer presión sobre las Fuerzas de Ocupación Israelíes para liberar inmediatamente a al-Sarsak y al-Rakhawi.

Al-Sarsak (28 años), de Rafah en el sur de la Franja de Gaza, está en huelga de hambre desde hace 88 días. Las FOI detuvieron a Sarsak, jugador del equipo nacional palestino, el 15 de julio de 2009 en Beit Hanoon en el cruce de "Erez" cuando se dirigía a jugar al fútbol al Club de Deportes de Balata. Las FOI mantienen detenido a Sarsak como un "combatiente ilegal". Desde entonces ha estado en el centro médico de la prisión de al-Ramleh, ya que sufre de asma, diabetes y otras enfermedades. Al-Rakhawi empezó la huelga de hambre como protesta por el deterioro de su estado de salud. Le pide a las FOI que lo pongan en libertad tras cumplir dos tercios de su condena.

Según fuentes de derechos humanos, al-Sarsak ya ha perdido alrededor de 30 kg. El Relator Especial de Naciones Unidas para los Derechos Humanos, Richard Falk, expresó su profunda preocupación por la suerte de al-Sarsak y al Rakhawi-: "Estas personas están protestando en contra de su detención sin cargos y están sufriendo enormemente por ello. No existe una base aceptable para mantener a estas personas detenidas, e Israel será responsable si resulta algún daño permanente."

El CPDH tiene gran preocupación por el destino de al-Sarsak y al Rakhawi-, que están en huelga de hambre en las cárceles israelíes, y está tratando de salvar sus vidas:

1. Exhorta a la comunidad internacional a ejercer presión sobre las FOI para que los liberen inmediatamente, a fin de salvar sus vidas.

2. Exhorta a las organizaciones de derechos humanos y organizaciones de solidaridad internacional para poner fin al uso indebido de las detenciones administrativas por las FOI, basándose en el término de "combatiente ilegal", en violación del derecho fundamental a un juicio justo.

3. Observa con profunda inquietud el deterioro de las condiciones de vida de los más de 4.700 prisioneros palestinos en las cárceles israelíes.

PCHR Appeals the International Community to Save the Lives of Palestinian Prisoners, Mahmoud al-Sersek and Akram al-Rakhawi, Who Have Been on Hunger Strike

 

The Palestinian Centre for Human Rights (PCHR) expresses extreme concern over the fate of Mahmoud Kamel al-Sersek and Akram Abdullah al-Rakhawi,who have been on hunger strike in Israeli jails for 88 days and 68 days, respectively. PCHR holds the Israeli Occupation Forces (IOF) accountable for their lives, and calls upon the international community to exert pressure on the IOF to immediately release al-Sersek and al-Rakhawi.

Al-Sersek(28), from Rafah in the south of the Gaza Strip, has nowbeen on hunger strike for 88 days. The IOF arrested al-Sersek, a member of the Palestinian national football team, on 15 July 2009 after stopping him at the Beit Hanoon "Erez" crossing while on his way to play football in the Balata Sports Club. The IOF dealt with al-Sersek as an 'illegal fighter.' Al-Sersek refuses to end his hunger strike, despite Isreal’s oral promises to release him next July, and insists that he needs a written pledge to release him in exchange for enduing his hunger strike.

Al-Rakhawi(39), also from Rafah, has now been on hunger strike for 68 days. He was arrested on 07 June 2004, and sentenced to 9 years of imprisonment. Since then, he has been admitted to the hospital in al-Ramla prison, as he suffers from asthma, diabetes and other diseases. Al-Rakhawi has started his hunger strike is in protest of his deteriorating conditions. He asks the IOF to release him after completing two-thirds of his imprisonment sentence.

According to human rights sources, al-Sersekhas lost around 30 kg already. Prisoner Support and Human Rights Association – Addameer’s lawyer said that al-Sersek’s health conditions are serious as he suffers from heart muscle weakness, problems in the bowels, inability to walk, blurred vision and pains throughout the body. He has also been suffering from frequent fainting. The Palestinian Prisoner Club reported that al-Sersek was transferred to AsafHarofeh Hospital, due to deterioration in his health conditions.

The UN Special Rapporteur for Human Rights, Richard Falk, expressed deep concern over the fate of al-Sersek and al-Rakhawi: “These individuals are protesting against their detention without charges and are suffering immensely for it. There is no acceptable basis for continuing to hold these persons, and Israel will be responsible if any permanent harm results.”

PCHR has extreme concern over the fate of al-Sersek and al-Rakhawi,who are on hunger strike in Israeli jails, and is seeking to save their lives:

1. Calls upon the international community to exert pressure on the IOF to immediately release them, in order to save their lives.

2. Calls upon human rights organizations and international solidarity organizations to put an end to the misuse of administrative arrests by the IOF, based on the term of 'illegal fighter,' in violation of the fundamental right to a fair trial.

3. Notes with grave concern the deterioration of living conditions of more than 4,700 Palestinian prisoners in Israeli jails.

Diversos futbolistas españoles, Javier Paredes (Zaragoza), Antonio López (Atlético de Madrid), Carlos Gurpegui (Athletic), Patxi Puñal (Osasuna), César Cruchaga y Juan Iribarren (ex preparador fisico con la Selección de México) han manifestado al Diario de Navarra, su solidaridad con el futbolista palestino Mahmud Sarsak que lleva 81 días de huelga de hambre, en protesta por detención administrativa. Mahmud sarsak es miembro de la selección palestina de fútbol y éste como cualquier otro aspecto de la vida palestina sufre la ocupación israelí.

Esta muestra de solidaridad se ha hecho cuando las organizaciones dedicadas a la promoción y protección de los derechos humanos, el Consejo Palestino de Organizaciones de Derechos Humanos (PCHRO) y Médicos por los Derechos Humanos-Israel (PHR-Israel) están seriamente preocupadas por las vidas de los tres presos palestinos que permanecen en huelga de hambre en una prisión israelí. Mahmud Sarsak y Akram Rikhawi fueron visitados por un médico independiente de PHR-Israel por primera vez desde que empezaron la huelga de hambre.

Mahmud Sarsak cumple hoy 81 días de huelga de hambre, lo que resulta una amenaza inminente para su vida. A pesar de la gravedad de su estado de salud, el Servicio Penitenciario Israelí (IPS) ha denegado a Mahmud el acceso a los médicos independientes de PHR-Israel hasta hoy. El IPS también se niega a trasladarlo a un hospital civil para un tratamiento adecuado. Después de la visita de ayer, el médico de PHR-Israel informó de que Mahmud ha sufrido una pérdida extrema de tejido muscular y pérdida drástica de peso. Ha perdido un 33 por ciento de su peso corporal; con un peso original de 76 kilos, su peso actual es de 51 kilos. Él también sufre frecuentes desmayos y pérdida de conciencia, además de lapsos de memoria. El médico informó además de que Mahmud corre el riesgo de interrupciones del pulso (arritmias) que están poniendo en peligro su vida.

Mahmud, de 25 años y miembro del equipo de fútbol nacional palestino, lleva detenido casi tres años bajo la "Ley de Combatientes Ilegales" de Israel, que permite mantener a los palestinos de la Franja de Gaza detenidos durante un tiempo ilimitado sin cargos ni juicio. Los detenidos en virtud del Estatuto tienen poca o ninguna protección legal, incluso menos que las personas detenidas en virtud de órdenes de detención administrativa en Cisjordania.

También la mayor preocupación es por el estado de Akram Rikhawi que hoy lleva 56 días de huelga de hambre. PHR-Israel ha hecho numerosas peticiones para acceder a Akram, pero todas han sido negadas hasta hoy. Después de la visita de hoy, el médico de PHR-Israel informó que Akram también sufre ya una extrema pérdida de tejido muscular y pérdida drástica de peso. Su peso se ha reducido de 68 a 50 kilos, lo que es una pérdida total de 26,5 por ciento. El médico de PHR-Israel determinó que una combinación de las enfermedades crónicas previas y las complicaciones de la huelga de hambre hacen que la hospitalización sea inmediatamente necesaria.

Un tercer preso palestino también permanece en huelga de hambre. Samer Al-Barq, de 38 años, mantenido en detención administrativa sin cargos ni juicio, desde el 11 de julio de 2010. Samer actualmente está en el centro médico de la prisión de Ramleh. Samer participó en la huelga de hambre masiva de los prisioneros palestinos desde el 17 de abril hasta el 14 de mayo. Él reinició la huelga de hambre el 21 de mayo como protesta por la renovación de la orden de detención administrativa, a pesar de un entendimiento del acuerdo que puso fin a la huelga de hambre masiva, lo que implica que los actuales detenidos administrativos no tienen sus órdenes renovadas.

Si bien la detención administrativa está permitida en virtud del derecho internacional humanitario, debe ser utilizada solamente bajo circunstancias excepcionales, ya que atenta contra los derechos humanos fundamentales, incluido el derecho a un juicio justo. En efecto, la negación de un juicio justo constituye una "infracción grave" de la Cuarta Convención de Ginebra, una de las formas más graves de crímenes de guerra. Esta forma de detención arbitraria también contraviene los artículos 9 y 14 del Pacto Internacional de Derechos Civiles y Políticos. Además, el Parlamento Europeo pidió a Israel, en una resolución de septiembre de 2008, "garantizar que las normas mínimas sobre la detención se respeten, para llevar a juicio a todos los detenidos, [y] para poner fin a la utilización de" órdenes de detención administrativa". El Comité de Derechos Humanos de Naciones Unidas ha declarado varias veces que la detención administrativa prolongada probablemente entraña la exposición de los detenidos a "tortura, malos tratos y otras violaciónes de los derechos humanos."

Dado el estado de salud crítico de los huelguistas de hambre y el hecho de que Mahmud Sarsak y Akram Rikhawi se enfrentan a la muerte inminente, el PCHRO y PHR-Israel:

·         Demandan que todos los huelguistas de hambre en etapas avanzadas sean trasladados de inmediato a hospitales civiles donde puedan recibir el grado de cuidado necesario;

·         Piden una intervención inmediata para que el IPS ofrezca a todos los huelguistas de hambre acceso ilimitado a médicos independientes;

·         Instan a los Estados Miembros de las Naciones Unidas que urgentemente hagan presión sobre Israel para poner fin a su política de detenciones arbitrarias y cumpla las normas estándar en el tratamiento de los reclusos adoptadas en 1955, que establecen lo que es generalmente aceptado como práctica y principio digno en el tratamiento de los reclusos;

·         Llaman al Parlamento Europeo para activar la misión de investigación parlamentaria que incluya a miembros de la Subcomisión de Derechos Humanos para investigar las condiciones de detención de los palestinos en cárceles israelíes;

·         Insisten en que la misión parlamentaria de investigación debe incluir una investigación de la práctica ilegal de Israel de la detención administrativa y el uso de la "Ley de Combatientes Ilegales";

·         Instan a los Miembros del Parlamento Europeo para llevar el caso de los tres huelguistas de hambre a la atención de las autoridades israelíes sin demora.

Independent doctor confirms current hunger strikers face imminent threats to their lives, 6 June 2012

Joint Urgent Appeal

As organizations dedicated to the promotion and protection of human rights, the Palestinian Council of Human Rights Organizations (PCHRO) and Physicians for Human Rights-Israel (PHR-Israel) are gravely concerned for the lives of three Palestinian prisoners that remain on hunger strike in Israeli prison. Today, Mahmoud Sarsak and Akram Rikhawi were visited by PHR-Israel's independent doctor for the first time since they launched their hunger strikes.

Mahmoud Sarsak is currently on his 80th day of hunger strike, resulting in an imminent threat to his life. Despite the urgency of his condition, the Israeli Prison Service (IPS) has denied Mahmoud access to independent doctors from PHR-Israel until today. The IPS also refuses to transfer him to a civilian hospital for proper treatment. Following today’s visit, the PHR-Israel doctor reported that Mahmoud has experienced extreme loss of muscle tissue and drastic weight loss. He has lost 33 percent of his body weight, from an original weight of 76 kilos down to his present weight of 51 kilos. He also suffers from frequent incidents of fainting and loss of consciousness, in addition to lapses in memory. The doctor further reported that Mahmoud is in danger of pulse disruptions (arrhythmias) that are endangering his life.

Mahmoud, 25 years old and a member of the Palestinian national football team, has been detained for nearly three years under Israel’s “Unlawful Combatants Law,” which allows for Palestinians from the Gaza Strip to be detained for an unlimited amount of time without charge or trial. Those detained under the Statute have little or no legal protections, even less than those detained under administrative detention orders in the West Bank.

Also of utmost concern is the condition of Akram Rikhawi, currently on his 56th day of hunger strike. PHR-Israel has made numerous requests to gain access to Akram but all have been denied until today. Following today’s visit, the PHR-Israel doctor reported that Akram also already suffers from extreme loss of muscle tissue and drastic weight loss. His weight has decreased from 68 kilos to 50 kilos, which is a total loss of 26.5 percent. The PHR-Israel doctor determined that a combination of inflammation of prior chronic illnesses and the complications of hunger strike render hospitalization immediately necessary.

Akram has been held in the Ramleh prison medical center since his arrest in 2004, as he suffers from many different chronic conditions, including diabetes and asthma. Akram began his hunger strike on 12 April in protest against his request for early release not being granted despite his medical condition. Yesterday, 5 June, his appeal for an early release on medical grounds was rejected. The IPS doctors’ threats to force-feed and force-treat him, in addition to their determination not to recommend his medical condition as worthy of earlier release from prison, has led Akram to regard them with deep distrust. Thus, he often refuses to receive treatment for his chronic illnesses, or the complications they generate.

PHR-Israel's independent doctor strongly recommended that both Mahmoud and Akram be immediately transferred to a hospital, as they are at immediate risk of death. These recommendations were given directly to the IPS doctor present with him during the visit. It should be emphasized that contrary to medical ethic and professional standards, the IPS refused the request of the independent doctor to go over the full medical files of both Mahmoud and Akram. He stated that according to the limited information accessible to him, the medical follow-up they have been receiving is insufficient both in frequency and scope.

A third Palestinian prisoner also remains on hunger strike. Samer Al-Barq, 38 years old, has been held in administrative detention, without charge or trial, since 11 July 2010. Samer is currently held in Ramleh prison medical center. Samer participated in the Palestinian prisoners’ mass hunger strike from 17 April until 14 May. He re-launched his hunger strike on 21 May in protest against the renewal of his administrative detention order in spite of an understanding in the agreement that ended the mass hunger strike, which implied that current administrative detainees would not have their orders renewed.

While administrative detention is allowed under international humanitarian law, it must be used only under exceptional circumstances as it infringes upon basic human rights, including the right to a fair trial. Indeed, the denial of a fair trial constitutes a ‘grave breach’ of the Fourth Geneva Convention, one of the most serious forms of war crimes. This form of arbitrary arrest also contravenes Articles 9 and 14 of the International Covenant on Civil and Political Rights. Furthermore, the European Parliament called on Israel in a September 2008 resolution to “guarantee that minimum standards on detention be respected, to bring to trial all detainees, [and] to put an end to the use of ‘administrative detention orders’.” The United Nations Human Rights Committee has stated several times that prolonged administrative detention is likely to result in the exposure of detainees to “torture, ill-treatment and other violations of human rights.”

Given the critical health condition of the hunger strikers and the fact that Mahmoud Sarsak and Akram Rikhawi face imminent death, the PCHRO and PHR-Israel:

·         Demand that all hunger strikers in advanced stages are moved immediately to civilian hospitals where they can receive the standard of care necessary;

·         Call for immediate intervention for the IPS to provide all hunger strikers with unrestricted access to independent doctors;

·         Demand that all hunger strikers are allowed family visits;

·         Urge the Member States of the United Nations to urgently put pressure on Israel to end its policy of arbitrary detention and to abide by the standard rules for the treatment of prisoners adopted in 1955, which set out what is generally accepted as being decent principle and practice in the treatment of prisoners;

·         Call on the European Parliament to activate the parliamentary fact-finding mission that includes members of its Subcommittee on Human Rights to investigate the conditions of detention of Palestinians held in Israeli prisons;

·         Emphasized that the parliamentary fact-finding mission must include an investigation into Israel’s illegal practice of administrative detention and the use of the “Unlawful Combatant Law”;

·         Urge Members of the European Parliament to bring the case of all three hunger strikers to the attention of relevant Israeli authorities without delay.
